This 2006 U.S. Supreme Court case involving Gil Garcetti, a district attorney for Los Angeles County, and Richard Ceballos, a deputy DA, had nothing to do with higher education and yet it has had a profound effect on the academic workplace, particularly at state-supported colleges and universities.

Hiring, promotion, and tenure activities are full of risk and potential landmines. Poor hiring decisions are not only costly, but the hiring process itself opens the institution up to litigation if everyone on the hiring committee is not trained properly.
The primary cost associated with an academic department is personnel. Personnel can include secretarial and support staff, but is typically dominated by faculty. In fact, as much as 95 percent of a department’s budget can be tied directly to faculty costs. This means that department heads and chairs have little room to negotiate around faculty and must instead face challenges directly. Compounding the chair’s ability to create change is the reality of academic freedom and tenure, both of which can immobilize progress and growth.
